Augusta, Ga (WRDW)------Augusta Commissioner Donnie Smith is under investigation. Smith is being investigated by Georgia Department of Public Safety for an incident on his job where he works as a lieutenant.
Commissioner Donnie Smith has been on administrative leave for at least a week but has worked for the state for more than 20 years.
One commissioner tells 12 all the facts come out and then judge.
Commissioner Corey Johnson says being on the commission is a part time job that pays $13,000 to $14,000 a year. He says what happens on your other job doesn't necessarily affect your commission business.
"The only thing I can say is that Donnie is my colleague and I support him. I hope everything works itself out. it's unfortunate what's going on here," said Commissioner Corey Johnson.
We went to the Richmond County Board of Elections office where Election Supervisor Lynn Bailey agrees the two jobs are separate unless there's a felony charge.
"I don't think a 9 to 5 affects your job as a commissioner of course, I'm fortunate enough to be a business owner. I'm flexible," said Johnson.
The Attorney General's Office tells us they would only get involved once an elected official is actually indicted on a felony.
The governor would appoint a group to investigate.
A hearing is held and the board makes a recommendation and that could mean being removed from office.
but, if no problems are found, they are put back into their position.
The Governor makes the final decision.
Commissioner Corey Johnson says let the courts or Georgia State Patrol handle the investigation. He says just because you're being investigated doesn't mean you done anything wrong.
"It's unfortunate that people cast judgement on folks before a judgement is rendered by a judge," said Commissioner Corey Johnson.
