Teen accuses deputies of assault with flashlight

AUGUSTA, Ga. (WRDW) -- Kyvan James is still wearing his orange hospital bracelet after he says three men in blue beat him black and blue.

"They said if you scream one more time for your mama or help, he was going to bust me in my face," he said.

His mother believes someone called 911 for a burglary at the Pine Place subdivision. James was walking home with his cousin when he saw several blue lights.

James says someone shouted, 'There they are,' and that's when he ran. He says he stopped running when deputies pulled their guns.

"So they picked me up and slammed me on the grass. They said, 'I wish you would've kept running so I had a reason to shoot you,'" he said.

A neighbor saw everything and called his mother, Kenya James, and she rushed to the scene.

"I asked him to please call EMS because my son has epilepsy. He's been in the back of that car for 45 minutes with no medical treatment," said his mother.

She says only when deputies found out no crime had been committed is when he was released and the ambulance was called.

"He told me to shut up. I'm talking, you listen. I said, no this is a dialogue, where we will exchange conversation. He said, 'No, I'm done,' and walked away," she said.

Hospital records show he was treated for a physical assault.

"We can't comment on something like that. What I can tell you is that we do have an internal investigation going on. I can't elaborate on it," said RCSO PIO Shane McDaniel.

James' mother is really hurt by all this.

"My heart is broken. I never wanted my child to go through something like this," she said.

Mrs. James says she's now worried about other children and plans to fight back.
