After filing a lawsuit against him one week ago, Augusta government watchdog Woody Merry is meeting face to face with commissioner Marion Williams for a deposition hearing. News 12 was there.

He may not have wanted to be there, but Judge Overstreet did order Marion Williams to appear before Woody Merry and his attorney this afternoon to answer questions under oath about the pending lawsuit.

“He’s violating my civil rights, one man, one vote, he’s not going to stop the democratic process,” Woody Merry said.

After filing a lawsuit against him one week ago, for the first time Woody Merry is meeting face to face with Commissioner Marion Williams.

“We’re not putting up with this anymore. We’re legally going to pursue this as far as we have to to bring aid to this dying community,” Merry said.

Under a judge’s order, Marion Williams appeared at the Neal Law Office for deposition, answering questions under oath from Merry and his attorney.

“When you have a commissioner whether he’s black or white abstaining, a gridlock in the government and then voting against himself for a job he says he wants, this is wrong and it’s going to stop,” Merry said.

The lawsuit comes after the January commission meeting where Merry says Williams illegally abstained twice from the vote for a mayor pro tem preventing the mayor from breaking a tie between he and Andy Cheek. Our cameras were not allowed inside, but after an hour or so of sworn testimony Marion Williams had little to say.

“No sir, I ain’t got no comment,” Williams said.

Attorney Joe Neal says Williams refused to answer some of his questions during the deposition like why he abstained but he says what the commissioner did say is enough for their case.

“We are confident we have the proof we need from his deposition to pretty much alone win this case,” Neal said.
