US Supreme Court denies stay for Ga. inmate Cook

Wednesday, Feb. 20, 2013

ATLANTA (AP) -- The U.S. Supreme Court has denied a request by Georgia death row inmate Andrew Cook to delay his execution.

Cook is one of two inmates scheduled to be executed this week. Warren Lee Hill's execution was put on hold Tuesday, less than an hour before he was set to die by lethal injection.

Attorneys for Cook had requested the U.S. Supreme Court to intervene. Wednesday's court order said Cook's application for a stay of execution had been denied along with his petition for a rehearing.

Cook still has an appeal pending before the Court of Appeals in Georgia, which was one of two courts to issue a stay in Hill's case. Both Cook and Hill argue the state is violating the law by using pentobarbital in executions without a prescription.
