COLUMBIA, S.C. (AP) -- A South Carolina state representative is facing his second driving under the influence charge in less than a year.

Department of Public Safety spokeswoman Sherri Iacobelli says Chesterfield Democrat Ted Vick was arrested at around 11 p.m. Tuesday by the Bureau of Protective Services.

Iacobelli says an officer saw Vick stumbling as he walked into a parking garage on the Statehouse grounds in Columbia. Vick got into his car and hit a cone before the officer could catch up and ask him to stop.

Iacobelli says Vick smelled like alcohol and refused field sobriety tests.

Vick was jailed Wednesday. Records listed no attorney, and it wasn't known when he'd appear in court.

Vick withdrew from a congressional race last year after a DUI arrest but was re-elected to the Statehouse.
