Lawyer: Ga. driver's license law unconstitutional

ATLANTA (AP) -- A lawyer for a Mexican citizen who was charged with driving without a license during a traffic stop in Georgia is asking the state's highest court to declare the section of state law that requires a driver's license to drive unconstitutional.

Georgia law says anyone living here longer than 30 days must have a Georgia driver's license. The law goes on to say that if someone violates that law they shall be punished unless they show up in court with a valid driver's license.

Lawyer Arturo Corso argued Monday that prevents illegal immigrants from getting a fair trial because they aren't eligible for a Georgia driver's license.

A lawyer for the state argued courts have previously ruled the driver must have a valid license at the time of the stop.
