Overstreet rules in favor of city in Woody Merry abstention case

The ruling came this morning from Judge Carlisle Overstreet.

He's been deciding the case since a hearing three weeks ago with several of the commissioners in court.

Woody Merry's attorney, Joe Neal, argued the government has been in gridlock for ten years because some commissioners wouldn't vote on critical issues.

City attorney Steve Shepard argued the charter says 6 “yes” votes can pass any issue.

Today the judge sided with the city's argument.

He also ruled Mayor Pro Temp Marion Williams can continue in that job until someone else is elected with six votes.

In the past Merry has said he'll appeal if the rulings go against him.
