The ruling regarding commissioners’ right to abstain from voting was expected this week.
Now, attorneys for commissioners who support abstaining issued a brief citing a case from the Georgia Supreme Court saying that a judge cannot issue advisory opinions.
However, attorneys supporting Woody Merry's claims that abstaining is illegal say that that ruling does not apply in this case.
