The trial involving an MCG doctor accused of causing a deadly head-on crash is delayed. Prosecutors say Mohammad Ali Bazadian was driving on the wrong side of the road and under the influence when he crashed into Brandon Layton’s car. News 12 sat down with Layton’s mother who says she has been waiting too long for the trial to begin.

“We just moved in a few months ago and I set Brandon’s bedroom back up the same way it was at the home he grew up in,” said Kathy Layton.

Kathy Layton says her world was crushed when her youngest child was killed. 18-year-old Brandon Layton never received his high school diploma. His mother Kathy Layton accepted it on his behalf.

“There’s always going to be a hole in my heart forever,” Kathy said.

On February 28, 2003, Brandon Layton was driving on River Watch Parkway. Prosecutors say Mohammad Ali Bazadian was driving under the influence on the wrong side of the road when he crashed head on into Brandon’s car killing the 18-year-old high school senior. Kathy Layton remembers walking into her son’s hospital room.

“I was told I couldn’t touch him. I can’t touch him because his body is evidence and will be taken to Atlanta for an autopsy. Bazadian also robbed me of holding my child one last time,” Kathy said.

“He had that on Thursday the day before he died, I won’t wash it,” Kathy said.

Kathy has been waiting for justice for the past three years.

“I’ve been patient now for three years and I’m ready to go to court and get this over with so that I can close that chapter of it and hopefully begin to try and heal,” Kathy said.

Kathy has dedicated her life to making sure Bazadian is put behind bars.

“I made a promise to my son in that hospital that night that momma would not let this man get away with having killed him,” Kathy said.

And Kathy says she won’t rest until Mohammad Ali Bazadian is convicted for killing her son.

No word yet on when Mohammad Ali Bazadian’s trial is set to start, it could be a few more weeks.
