Warrenton Mom Pleads Not Guilty

Not guilty is her plea. Now her quest to prove that beings. News 12 was at Monday’s arraignment.

Lottie Kain appeared sad and emotional in court Monday. She hugged her lawyer as he entered her not guilty plea. Cameras were not allowed in the courtroom for the two-minute arraignment, but we pick up the story from there.

Dressed in an orange jumpsuit, an ashamed Lottie Kain covers her face as she leaves the courtroom. This mom’s two toddlers, 2-year-old Nicole and 3-year-old Jonah, drowned in a retention pond in April.

Kain is charged with not watching them, which lead to their death. She pleaded not guilty. The children’s father, Dennis Payne, came to the arraignment and wouldn’t say much afterwards.

C.D. Morris came to court to support Kain. He’s known the family for two years. Morris says despite the fact that the Department of Family and Children Services made weekly visits to their house since 2003, Lottie and Dennis were good parents.

“Every time I seen the children with them they was always neat and clean. They look like they was always taken care of, well fed,” Morris said.

According to District Attorney Dennis Sanders, Lottie Kain’s trial will be at the Warren County Courthouse on October 3.

This may not be the only charge facing Jonah and Nicole’s parents. Sanders says the cause of drowning is still being investigated.

“There’s evidence pointing in a number of different directions, but at this point there has been no conclusion,” Dennis Sanders said.
