AUGUSTA, Ga. (WRDW) -- Nearly three months after a deadly shooting at University Hospital the man suspected of pulling the trigger remains out on bail.

Tim Grooms, 59, was shot and killed inside a patient room on the 7th floor of the hospital last October.

Deputies say Grooms' uncle, Charles Gorrell, was the gunman but he still hasn't been indicted on those charges.

"I've been robbed of so much," said Linda Grooms, husband of the victim.

Grooms, along with her husband's brother Terry, have one question about the man suspected of killing their family member.

"Why has he been out of jail since Thanksgiving and why is he still out of jail?" asked Terry Grooms.

Deputies say Gorrell is the man who walked into the hospital room and pulled the trigger. The Grooms say the 83-year-old is getting special treatment due to his age and health.

"We are very much against him receiving preferential treatment from the courts of Richmond County," said Terry Grooms.

News 12 was at Gorrell's first bond hearing right after the shooting. There, Judge William Flemming denied his bond, saying he was a threat to the community. But three weeks later, Judge Daniel Craig granted Gorrell bond due to poor health.

News 12 contacted the District Attorney's office, which wouldn't comment specifically, but did tell us, "The case is being handled appropriately."

It's little comfort for grieving family members who say they just want justice.

"I want him to pay for what he did," said Linda Grooms.
