Wednesday, Nov. 21, 2012

COLUMBIA COUNTY, Ga. -- A former investigator with the Richmond County Sheriff's Office is in the Columbia County Jail on a rape charge.

David Dutton was arrested Tuesday and charged with rape, aggravated sexual battery, unlawful eavesdropping or surveillance and making false statements.

Dutton is being held without bond at this time.

According to an incident report, the alleged victim said she found pictures and video of a sexual encounter on Dutton's cellphone. She says the sex was not consensual, but Dutton told investigators that it was consensual. The woman said she had taken "prescribed medication'' the night of the alleged incident.

The cellphone has been confiscated by the Columbia County Sheriff's Office for the duration of the investigation.
