AUGUSTA, Ga. -- A 22-year-old accused of drunken driving and hitting and killing a father of three on Father's Day appeared in court on Friday.
Alphonso Milton's wife, Sherry Milton, was in court to meet her husband's accused killer face to face, and she's not so sure about the outcome.
"I felt kind of nervous at first, to be in the same room as the woman who caused the death of my husband. It felt kind of weird to know that she was there in the very same room as me," Milton said.
A tearful Luke was taken back into custody to await her next day in court after the judge continued her bond hearing.
"Right now, I feel kind of relieved to know her bond was not actually denied. But at least she's still in jail," Milton said.
The 40-year-old was driving his motorcycle on Windsor Springs Road when Luke allegedly turned left in front of him.
"I wish the state had made a better argument against her at the bond hearing," Milton said. "There was a lot of evidence they didn't state at the bond hearing."
During the hearing, the defense stated, "She was turning into a driveway at a shopping center around 2 o'clock in the morning."
The state failed to mention that the "shopping center" was actually Crazy Leggs Nightclub.
"I don't want her out on the streets because of her drinking history, drinking and driving history," Milton said.
Luke has another pending DUI from an incident just three months prior to this one. She has not been convicted for that charge.
Milton is coping, but adds, "Right now, I'm at that stage where I'm very angry."
The judge continued the bond hearing until the defense could come up with a way to monitor Luke to ensure she isn't allowed to drink alcohol.
"The way they could make it right for me is to give her the maximum punishment. To make an example out of her," Milton said.
Luke is charged with homicide by vehicle, DUI with alcohol and drugs and failure to yield. Toxicology results are still pending. The judge neither set nor denied her bail, so she is still in custody until another bond hearing date is set.
