WHITE PLAINS, N.Y. (AP) -- A person familiar with the decision says New York's child protection agency has found no evidence that the infant son of a Kennedy heir was ever abused.
The person spoke to The Associated Press on condition of anonymity because the decision had not yet been made public.
The Office of Children and Family Services investigated after Douglas Kennedy was charged with child endangerment in February. Kennedy is the son of the late Sen. Robert F. Kennedy.
The charge stemmed from Kennedy's attempt to take the infant from a suburban hospital's maternity ward. He said he wanted the baby to get fresh air.
A March 30 letter from the agency provided to the AP says a report of suspected child abuse was determined to be unfounded.
Kennedy's lawyer says the finding does not directly relate to the child endangerment charge. But he hopes prosecutors will consider it and dismiss the charge.
Kennedy is also accused of harassing two nurses in the incident.
