Nephew forced to shoot uncle after refusing to stop choking the boy's dad

COLUMBIA COUNTY, Ga. (WRDW) -- A man is in the hospital recovering and awaiting charges after deputies say he was shot in the back.

Columbia County officers were called to 2500 Louisville Road for a shooting around 2:20 Saturday morning. When they got there, deputies found Kenneth Wayne Newman Jr on the kitchen floor with a gunshot wound to his back.

Deputies say Newman came to the home intoxicated and began damaging property belonging to Richard Green. According to the report, Newman threatened to kill Green, started punching him, put him in a headlock and then began to choke him.

When Green's 15-year-old son Evan walked in and saw the fight, deputies say he tried to stop it. When that didn't work, officer say he grabbed his .22 caliber rifle from his bedroom and threatened to shoot his uncle, Kenneth Newman, if he didn't stop choking his dad.

Newman did not stop choking his dad, so Evan shot him once in the back.

The report says Evan will not be charged. However, deputies say there were five other people in the home at the time. Officers say Dusti Headley was one of them. They say she was also fighting with Richard and Evan.

Headley will be charged with False Statements and two counts of Battery. Newman was taken to GRU, and charges are pending against him.
