COLUMBIA COUNTY, Ga. (WRDW) -- The motion for a new trial and the motion for a sentence modification for Scott Dean has been denied, Judge James Blanchard said.
Earlier this month, the former Columbia County Commissioner and Harlem Mayor, requested the new trial, after his step-daughter reportedly recanted her allegations that Dean had molested her.
In 2011, Dean was found guilty of exposing himself to the teenage accuser and was also found guilty on another count of touching his teenage daughter.
Judge Blanchard said the impact of the teen recanting her statements is simply to impeach her testimony and is not new evidence. He said that is not a basis for a new trial.
In Judge Blanchard's ruling on the motion for a sentence modification, he said the motion was not filed by the Sept. 25 deadline.
