HEPHZIBAH, Ga. (WRDW) -- Mary Katherine Smith has been indicted for murder after her son died in her care in July.

Smith is accused of putting Mason in his room for discipline on July 30. While in the corner, Smith said Mason held his breath, passed out and hit his head.

An investigator revealed that Smith's boyfriend, Jeremy Kitchens, and another child were in the home when the incident happened, the investigator said. It took Smith and Kitchens three hours before contacting medical assistance, an investigator said.

Mason was pronounced dead on Aug. 2 at GRU Children's Medical Center. Click here to read comments from Smith's court hearing and why Smith denied a drug test on the day of the incident.

Smith was originally charged with second degree cruelty to children. She now faces a murder in the second degree charge, according to court documents.
