Fired RCSO deputy suspended twice from different agencies

AUGUSTA, Ga. (WRDW) -- The Richmond County Sheriff's Office says they would think twice before hiring fired Deputy Brian McDuffie. They're releasing new details about his past.

Sheriff Richard Roundtree fired 33-year-old McDuffie for using excessive force on 15-year-old Kyvan James.

Documents show the former Richmond County deputy has a misdemeanor for disorderly conduct and was suspended twice at two different law enforcement agencies.

"If I would have seen the fired from the reserves and if the sheriff saw what Chief Allen sent, he would've paused," said RCSO Chief Patrick Clayton.

Clayton is talking about what's in McDuffie's file. News 12 found he was written up for conduct unbecoming of an officer, abusive language and abuse of sick leave among other things. When McDuffie applied to work in Richmond County, the then Waynesboro Police Chief wrote he recommended "close supervision if he is hired."

"If it looked like an isolated incident or behavior, of course, we would consider hiring someone with a record. If it looked like a pattern of behavior, no, we wouldn't hire them," Clayton said.

McDuffie was suspended for two days in Richmond County for giving a suspect an avenue to escape. The report says he arrested a woman put her in the back of the car, left the screen open and the suspect drove off in his car. The suspect then lead deputies on a chase.

"No one knows what it's like to wear that badge," said Shandina McDuffie, who is married to Brian McDuffie.

"We all make mistakes, but this looks like a pattern of behavior," Clayton said.

Despite the challenges, each of the agencies McDuffie has worked for report that they would rehire him.
