South Carolina death row inmate Stephen Stanko wants a new trial.
He was convicted of killing his girlfriend and sexually assaulting her daughter. After the crime, Stanko was captured in Augusta.
Stanko's lawyer is appealing to the state Supreme Court, saying there was a problem in questioning potential jurors.
The state argues Stanko's lawyers didn't object during jury selection, so that can't be appealed.
Stanko also faces a death penalty trial in the murder of another man.
