Couey in court for mental capacity hearing

IVERNESS, Fl.---Convicted killer John Couey is back in court. A judge in Florida is hearing arguments about Couey's mental capacity and whether he can be put to death.

Couey, who was arrested in Augusta, was convicted in March for the 2005 murder of nine-year-old Jessica Lunsford. The jury recommended the death penalty.

A licensed clinical psychologist says he tested Couey in jail and found that Couey has adapted too well and tested too high to be considered mentally retarded.

If the judge does find Couey mentally retarded, he would be ineligible for the death penalty.

The judge is expected to formally sentence Couey in August.
