WAYNESBORO, Ga.---The Burke County Sheriff's Office has dismissed the kidnapping arrest warrant against Deloris Miller, the grandma who was accused of taking her daughter's young son. Miller and the child were found in Tennessee with the child's father.

Investigators say they've learned neither the baby's mom nor dad have filed paperwork in Georgia or Tennessee for custody, meaning they have equal custody.

The mom lives in Midville; the dad, in Tennessee.

The child is now home with his mother, and deputies have advised the parents to work with lawyers.
