Merry files appeal over abstention ruling

Augusta commissioners could be headed back to court.

Woody Merry and his attorney Joe Neal have filed an appeal to the Georgia Supreme Court.

They say Judge Carlisle Overstreet's ruling last month has not brought about the change they expected.

They say his ruling never defined what a simple majority vote is.

Merry says he wants a judge to force the Commission to elect a new mayor pro-tem, and he wants the mayor to use his power anytime a commissioner abstains.
