AUGUSTA---A deputy shot and killed a man during a struggle outside Five Guys Burgers & Fries on Washington Road in Augusta.

Deputy Walter Garrison had 22-year-old Kevin Pao in the back of his car when the shooting happened. Pao was pronounced dead at the scene. The Georgia Bureau of Investigation is now in charge of the case.

Investigators say when Deputy Garrison told Pao he could not take his bag into the car, Pao reached for his bag. Garrison reportedly asked him to stop and there was a struggle. Pao was shot in the chest and died on the scene.

The deadly shooting has rattled some people in the neighborhood. Matt Myers is still in shock. "It just blew me away," he said. "I usually don't hear about things like that."

Investigators say a semi-automatic gun was found in Pao's bag.

Records show Garrison became a deputy on May 1st. While people I spoke to today support the deputy's actions, there are still many questions surrounding the shooting. It's still unclear how many shots were fired and how many times Pao was shot.

Linda Libby was at Five Guys a little after the shooting happened. "It's very sad...very sad...but at the same time people have to be protected."

Lee Jeffcoat says, "I think he did the right thing in protecting himself and protecting others."

Investigators say this all happened after restaurant workers were complaining about Pao. They say he was bathing in the restroom of the restaurant and had been there several times in the past week. That's when Deputy Garrison arrived at the restaurant by himself and began questioning Pao.

The victim's last known home is in Rockville, Maryland.
