12 On Your Side: Lawsuit names Richmond Co. schools, former teacher

AUGUSTA, Ga. -- Parents of a elementary student have filed a civil action lawsuit against the Richmond County School System, school superintendent and a former teacher.

The 24-page lawsuit claims Kayrie Washington Cargil, known to students as Ms. Washington, terrorized her students.

From the civil action lawsuit:
"Cargill forced a student to stand in the corner alone and forgot about him after school was dismissed." "Cargill called a student stupid and refused to allow him to use the bathroom causing the student to wet himself in front of his classmates." "Cargill pulled mucous from her nose and placed it in a student's hand ... forced the student to eat the mucus."

The lawyers for the parents of a Tobacco Road Elementary student filed the lawsuit this month.

Dorothea Goudeau can't comment on the case right now but earlier this year told News 12, "She's traumatized, my baby, she got her scared and everything. Simone loved school and every time she sees her she shakes."

Goudeau and her husband say their daughter still suffers extreme mental pain, anguish and emotional distress from her former teacher. They claim Ms. Washington put her hand around their daughter's neck and forced her head down toward a desk. They also say the teacher harassed their daughter while she was in school.

The Goudeau's lawyers also want the courts to hold the Richmond County School System and interim school superintendent accountable for not taking action. Washington's personnel file shows she moved schools for a fresh start, that her bosses sent her letters of reprimand and even gave her an unsatisfactory grade.

She resigned at the end of the 2010-2011 school year.

School officials would not comment about the case.

The case now goes to discovery, which means both sides begin with gathering depositions and exchanging documents. That step could take about four months.
